Terms & Conditions - Sale of 3.5T Horsebox

      1. Introduction:

       

      These Terms and Conditions govern the sale of 3.5 tonne horseboxes (“the Vehicle”) between [Herefordshire Horseboxes] (“the Seller”) and the buyer (“the Buyer”). By purchasing the Vehicle, the Buyer agrees to be bound by these Terms and Conditions.

       

      1. Sale Agreement:

       

      2.1 The sale is subject to the Buyer’s acceptance of these Terms and Conditions.

      2.2 All prices quoted are subject to change and are inclusive of VAT unless otherwise specified.

      2.3 The Buyer is responsible for ensuring that the Vehicle is suitable for their needs before making a purchase.

       

      1. Warranty:

       

      3.1 Mechanical Warranty:

      The Vehicle is covered by a 3-month or 1,000 miles mechanical warranty from the date of purchase. This warranty covers the repair or replacement of faulty parts under normal usage. (maximum value per claim £500).

      The customer is responsible for obtaining breakdown cover in the unfortunate event of the vehicle needing to be recovered to an authorised designated premises for repair.

       

      3.2 Body Structure Warranty:

      The Vehicle is covered by a 12-month warranty on the body structure, excluding paintwork through the coachbuilder.  This warranty covers defects in materials or workmanship that affect the structural integrity of the Vehicle.  The vehicle must be returned to the Coachbuilders premises in Norfolk at the owners cost.

       

      3.3 Exclusions:

      The following are excluded from the warranty:

      • Damage to the structural integrity of the Horsebox caused and including, but not limited to, damage resulting from horses being tied to the tie rings or any stress placed on the structure as a result of such use. It is the responsibility of the owner to ensure that horses are securely and properly tied, and not left unattended at anytime. 
      • Damage caused by commercial use, unless specifically agreed upon in writing.
      • Damage resulting from vermin or animals.
      • Oil leaks are excluded.
      • Damage caused by misuse, neglect, or failure to maintain the Vehicle in accordance with the manufacturer’s guidelines.
      • Paintwork and cosmetic finishes.
      • Any alterations made to the Vehicle by the Buyer or a third party.
      • General wear and tear including, but not limited to, tyres, brakes, and suspension.
      1. Liability:

       

      4.1 The Seller’s liability under this agreement is limited to the repair or replacement of defective parts, or the refund of the purchase price in the event that repair or replacement is not possible.

      4.2 The Seller will not be held liable for any indirect or consequential damages arising from the use of the Vehicle, including loss of income, loss of use, or any other incidental costs.

       

       

      1. Delivery:

       

      5.1 The Vehicle will be delivered to the Buyer as agreed upon in the sale contract. The risk of loss or damage to the Vehicle passes to the Buyer upon delivery.

      5.2 Any delivery dates provided are estimates and may be subject to change.

       

      1. Ownership:

       

      6.1 The Vehicle remains the property of the Seller until full payment has been made.

      6.2 The Buyer agrees to take all necessary steps to ensure that the Vehicle is fully insured from the date of delivery.

       

      1. Sales of Goods Act:

       

      These Terms and Conditions do not effect your statutory rights under The Sale of Goods Act, 2015.
